The state first asked Tahir Canan to pay "ration allowance" for the meals he had in prison for 30 years 10 months . Canan is also blocked to bring a lawsuit against the state.
Son of Tahir Canan, İlhan Canan made a statement to bianet:
"My father objected to "ration allowance" asked in November 2011. He expressed that he had no assets as he was in prison for the last 31 years"
58 year-old Tahir Canan had brought a lawsuit against Balıkesir Administrative Court which had issued a notification to obtain the money.
İlhan Canan explained why the procedure was unlawful :
"Legally they cannot issue a notification to a convict on financial matters . However, they notified my father about the "ration allowance". My father wanted to file a lawsuit against them."
"No one warned my father about the fact that a convicted person is not allowed to open a case at the initial state. My father paid all the document and court costs"
"At the end they said my father was a convicted person and he had no right to open a lawsuit."
"Thereupon, I received a letter about guardianship. We wrote the necessary petition and sent it to the authorities. We were then told that we had passed the 10 day deadline to submit our request. Yet, there was no warning or notification on the documents that were sent earlier. Our request for legal guardianship was turned down based on the fact that we had missed the deadline." (EKN)
