The fifth hearing of the case filed against fugitive defendants of October 10 Massacre was held at the Ankara 4th Heavy Penal Court today (July 16).
The intervening lawyers requested that the extradition procedures of the fugitive defendants, who were identified to be in camps in Syria, be investigated. While the documents as to their presence in the camps were also added to the case file, the court has rejected the request.
The next hearing will be held on September 21, 2020.
Is he not caught as he is an intelligence officer?
An attack was launched against the Peace Rally in the capital city of Ankara at 10.04 a.m. on October 10, 2015. While 69 people lost their lives at the scene of incident, a total of 103 people lost their lives.
In the ensuing lawsuit into the attack, nine defendants were previously sentenced to life imprisonment aggravated for 101 times and 10 thousand 557 years in prison each on charge of "attempted murder."
The case files of 17 fugitive defendants were separated. In the ensuing case, 16 fugitive defendants and Erman Ekici, who was caught, stand trial.

As reported by daily BirGün from today's hearing, defendant Fadile Delibaşlar is in Roj Camp while Cebrail Kaya is in the SDF camp.
As announced by intervening lawyers on social media, according to the investigation documents sent from the Gaziantep Security Directorate, fugitive defendant Mustafa Delibaşlar is in the SDF camp in Syria.
The lawyers also noted that suicide attacker Ömer Deniz Dündar was not caught even though there were tip-offs and findings about him.
According to the documents presented to the court from the Gaziantep Security Directorate, "Ebubekir" codenamed İlhami Balı is also in a camp in Syria, but it is not said which camp he is in. Lawyers asked "whether the reason for not sharing information about the camp was that there were tapes in Kilis file suggesting that Balı was an intelligence officer."
Was the extradition of defendants requested?
The lawyers also asked the court "if it was known that the defendants were in camps, why this information was not added to the file." They also requested that "the National Intelligence Organization (MİT) be asked where all defendants were and what kind of an action was taken for the extradition of fugitive defendants identified to be in camps."
"The only reason why fugitive defendants İlhami Balı, Mustafa Delibaşlar and Cebrail Kaya, who have been identified to be in camps, will not be present in the courtroom is Turkey's will of not taking a step to ensure their extradition to Turkey," the lawyers indicated further.
In previous hearings, it was understood that before the massacre took place, it was learnt that Yakub Şahin, who carried the bombs to Ankara, bought manure for bomb making. Lawyers filed a complaint against the prosecutors of the investigation who did not take any action against him.
The lawyers also requested that the court file a criminal complaint against all security directors of Gaziantep Provincial Directorate of Security, who took no action despite being informed by the Nizip District Security Directorate, which identified Şahin based on the tip-off of the manure seller.
The court board of the Ankara 4th Heavy Penal Court has rejected the requests for criminal complaint and ruled that Erman Ekici, the only arrested defendant of the case, shall remain behind bars. The court has also rejected the request for investigating the camp where İlhami Balı is.

The teams arrived after 1.5 hours and deputy public prosecutor after 2.5 hours. The indictment concerning the attack was approved on July 13, 2016. The indictment stated that the attack order was given by Islamic State of Iraq and Syria's (ISIS) representative to Turkey İlhami Balı. It was stated in the indictment that it was the same people who organized the Suruç attack, which killed 33 people. 14 suspects including Balı face from 5,083 to 7,820 years in prison on charges of "attempted murder for multiple times" and "attempting to annihilate constitutional order". The trial started on November 7, 2016 and still continues. The families of the deceased hold a commemoration ceremony on the 10th day of every month in front of the Train Station. |
