Istanbul Anatolia 7th Peace Court rejected the removal request of a bianet news article by T.S., a plaintiff who battered his ex-girlfriend.
The plaintiff also claimed that he committed his deed under provocation. The judge Ahmet Kaya, on the other hand, reminded Constitution Articles 25 on freedom of expression, Article 26 on freedom to disperse thought and opinions and Article 28 on press freedom.
Court: No evidence on purposed insult
The court also ruled that the aforementioned article’s tone and the words selected didn’t constitute any purpose on insulting the individual rights of the plaintiff.
“It must be understandable that this sort of articles and news stories has an aggressive tone. The court decided that the protection of press and expression freedom must be prioritized to the aforementioned complaint,” the ruling cited.
The plaintiff has right to appeal to the ruling within 7 official days. (EÖ/BM).
